Terms of Service

Sponsored Clients

1. Introduction
These Terms of Service (‘Terms’) govern access to and use of our services for individuals whose organisations sponsor their use of Coaching Centre services. These may include online (virtual) coaching, in-person coaching, courses, workshops, our website, and any related software, applications, tools, or other services we may provide from time to time (collectively, the ‘Services). By accessing or using our Services, you agree to be bound by these Terms of Service.
2. Definitions
Coach means an agent who completed Coaching Center certification and appointed by the Coaching Centre to provide professional coaching. When applicable, this may refer to an AI coach developed exclusively for the Coaching Centre. The Participant would be made aware of this during their interaction. Coaching means one-on-one or group service conducted online or in person between the Participant and the Coach and is an integral part of the Services. Coaching Platform (‘Platform’) refers to the technology provided by the Coaching Centre that enables the Services. Confidentiality means the principle and practice of keeping sensitive information private unless the owner or custodian of the data gives explicit consent for it to be shared with another party. Organisation means an incorporated body or any other legal entity that engages the Coaching Centre to provide the Services to the Organisation, its employees, contractors, or any other affiliated entity and individuals that the Organisation has the authority to negotiate the Services with the Coaching Centre. Participant means an individual, an organisation’s employee receiving Service.Personal Information means personal data or personally identifiable information (PII) in accordance with The Privacy Act 1988 (the Privacy Act). Program means a coaching program that consists of an outline detailing how the Service will be delivered. This includes program length, session duration, or any other pertinent information as designed by the Coaching Centre and instructed by the Organisation. Service Provider (‘Provider’) means the Coaching Centre and its representatives. Services means coaching or any other services provided by the Coaching Centre, as outlined in the coaching program offered by the Coaching Centre and chosen by the Organisations. Session means a one-time interaction between the Client and the Coach during which the Coaching is delivered.
3. Duties, Obligations and Responsibilites
3.1. Coaching Centre
(a) Provides tools and other requirements necessary to deliver the Services, ensuring they are available to the Participants and Coaches on the day of the Services commencement. (b) In the event of unforeseen circumstances or disruption, the Provider will endeavour to find the most appropriate solution as soon as possible. (c) Ensures that all its representatives operate to the highest professional standards, adhere to the Intentional Coaching Federation (ICF) Code of Ethics, and possess relevant accreditation to deliver the Service.(d) Monitors and avoids any conflict of interest and works with the Organisation to address these as soon as it becomes aware of a conflict or a significant risk of a conflict.(e) Commits to address any issues raised by the Participant in a timely manner. (f) Except as specified in this agreement, the Coaching Centre makes no guarantees or warranties regarding the Services. The Coaching Centre and its representatives are not liable for indirect or consequential damages.
3.2. Organisation
(a) Ensures that Participants enrolled in the Program or any other Services provided by the Coaching Centre have all the resources, tools, and allocated time necessary to deliver the Services. (b) Ensures that all involved understand that the coaching services will be focused on the areas and goals chosen by the Participant. (c) Ensure that all parties involved understand the vital importance of Participants' confidentiality in their engagement with their Coach.
3.3. Participant
(a) Participant is solely responsible and liable for any action or inaction, or any direct or indirect results of the Services, as well as for their choices and results arising from or related to the Services.(a) Participant understands that coaching is a comprehensive process that may involve various aspects of their lives, including finances, health, relationships, education, recreation, and work with the Organisation. Participants agree that decisions regarding these areas, including the integration of coaching principles and implementation of choices, are solely their responsibility and not that of the Coach or the Provider.(b) Participant understands that coaching is distinct from consulting, which typically involves providing expert advice and solutions to specific problems. It is the Participants' exclusive responsibility to seek such services independently or through their Organisation.(c) Participant is responsible for their own physical, mental, and emotional well-being. (d) Participant acknowledges that coaching does not involve the diagnosis or treatment of mental disorders, and it is not a substitute for therapy, counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical, or other qualified professionals. Participants agree that it is their exclusive responsibility to seek such independent professional guidance and advice as needed. If Participants are currently under the care of a mental health professional, it is strongly recommended that they promptly inform the mental health care provider of the nature and extent of the coaching relationship. (e) Participant acknowledges and agree that to maximise the coaching relationship with their Coach, they will communicate honestly, be open to feedback and assistance, allocate sufficient time and energy to fully participate in the coaching process, and show any effort to put into practice areas of focus as agreed with their Coach.(f) Participant acknowledges that they will show their best effort to schedule coaching sessions well in advance, preferably 72 hours or at least 48 hours before the proposed time. (g) Participant agrees to make every effort to avoid cancelling or rescheduling coaching sessions on short notice, within 24 hours before the scheduled start time. Participants acknowledge that such short-notice changes may result in forfeiting sessions from the allocated session pool.(h) Participant takes full responsibility for acquiring the necessary skills to operate the technology or tools before the first meeting with the Coach. (i) Participant acknowledges that they will endeavour to communicate with their Coach promptly and via the messaging system provided by the Coaching Centre. (j) Participant acknowledges that they will raise any issues with the Coaching Centre in a timely manner.
3.4. Caoch
(a) Coach will engage with the Participant in a thought-provoking and creative process that inspires them to maximise their personal and professional potential, while maintaining openness, transparency, and honesty throughout the coaching relationship.(b) Coach will always keep the Participant’s best interest in mind. (c) Coach will maintain ethical standards in accordance with the International Coaching Federation (ICF) Code of Ethics, accessible via www.coachingfederation.org.(d) Coach will accurately represent their qualifications, expertise, experience and credentials. (e) Coach will strive to identify issues that may affect their coaching performance or professional coaching relationships, including real or perceived conflicts of interest. They will openly disclose any such conflicts, offering to remove themselves when necessary. (f) Coach will hold the Participant accountable for their objectives and prioritise the client's agenda at all times, ensuring that the scope of coaching remains focused on the areas identified by the Participant at the beginning of the coaching, with additional areas determined by mutual agreement.(g) Coach will uphold the confidentiality of the Coach-Participant work and ensure that any information recorded maintains the highest standards of record-keeping. (h) Coach will make their best effort to be available for the Participant to book coaching sessions at times mutually agreed upon by both the Coach and the Participant.(i) Coach acknowledges that they will endeavour to communicate with the Participant promptly and via the messaging system provided by the Coaching Centre.
4. Confidentiality
4.3. The coaching relationship and all information (documented or verbal) shared by the Participant with the Coach are subject to confidentiality principles outlined in the ICF Code of Ethics. The Coach agrees not to disclose Participant information without the client's consent, except in cases where confidentiality may not be maintained, such as illegal activity or court orders. All parties involved understand these limitations. Confidential information does not include data that was already known to the coach, publicly available, obtained from third parties, independently developed, required by law, or disclosed due to imminent danger. The client should promptly raise any confidentiality concerns with the Coach.4.4. Coach may keep notes of coaching sessions for the purpose of maintaining continuity in the coaching relationship, primarily benefiting the client. These notes will be securely maintained in compliance with applicable laws, agreements, and regulations. The coach will explain the nature and purpose of record-keeping, safekeeping, and disposal.
5. Data Protection and Privacy
5.3. The Coaching Centre is committed to collecting personal data only necessary to provide the Services and will not disclose or provide access to client data to any third parties without the express consent of the Participant, except when required by law or legal process, adhering to The Privacy Act 1988 (Cth).5.4. The Coaching Centre acknowledges that Participant data, including but not limited to personal information, communication records, and coaching materials, will be stored on a secure online platform hosted in Australia, which complies with world- standard privacy protection laws and regulations.5.5. The Coaching Centre is committed to maintaining the security and confidentiality of all data. Its chosen online platform employs robust security measures to protect against unauthorised access, data breaches, and other security threats.5.6. The Coaching Centre retains the Participant’s data for the duration of the coaching relationship and for a reasonable period thereafter as required for legal, contractual, or auditing purposes. After this retention period, the data will be securely and permanently deleted.5.7. Participants are responsible for maintaining the confidentiality of their login credentials and are encouraged to use strong, unique passwords to access the Platform.
6. Feedback, Evaluation and Support
6.3. Coaching Centre conducts coaching sessions and end-of-program surveys to improve service quality.6.4. Participant is encouraged to provide ongoing feedback to their Coach and Coaching Centre.6.5. Participant is encouraged to seek support by contacting the Coaching Centre via the support email address provided to the client at the commencement of the Services.
7. Acknowledgment of the Terms of Services
7.3. By proceeding to receive the Services, the Participant acknowledges understanding and acceptance of the Terms.
